ALEVOSÍA Y DOLO EVENTUAL: ANÁLISIS DE
COMPATIBILIDAD

RESUMEN | El presente artículo tiene por objeto analizar el concepto de alevosía, circunstancia
agravante propia de los delitos contra las personas, así como el concepto de dolo y los diversos
tipos del mismo que pueden existir en el ordenamiento jurídico español, para finalmente entrar a
valorar su compatibilidad, en aquellos casos en que se aprecie la existencia de ambas, con la
suficiente profundidad como para aclarar la posibilidad de armonizar estas dos figuras jurídicas
cuya concurrencia no ha estado exenta de debate. A tal fin, hemos analizado los estudios en la
materia de diversos autores, esclareciendo el tema que nos ocupa desde una perspectiva
doctrinal; igualmente hemos estudiado algunas significativas sentencias que han terminado de
arrojar luz sobre una cuestión que, pese a haber dado lugar a una diversidad de posturas, en
ocasiones contrapuestas, parece haber superado finalmente este escollo y estar finalmente
aceptada esa dualidad conceptual, de alevosía y dolo eventual.

Perfidy and eventual will: compatibility analisys

ABSTRACT | This article aims to analyse the concept of perfidy, an aggravating circumstance of
crimes against persons, as well as the concept of will and the various types of it that may exist in
the Spanish legal system, in order to finally to assess their compatibility, in those cases where the
existence of both is appreciated, with sufficient depth to clarify the possibility of harmonising these
two legal figures whose concurrence has not been without debate. To this end, we have analyzed
the studies on the subject of various authors, outsetting the subject we are dealing with from a
doctrinal perspective; we have also studied some significant sentences that have ended up
shedding light on an issue that, despite having given rise to a variety of positions, at times
conflicting, seems to have finally overcome this pitfall and finally be accepted that conceptual
duality, of alevosia and eventual will.
